Befriend Cows is a California 501(c)(3) nonprofit. We fund partner sanctuaries in India, publish humane education materials, and build free digital tools for small animal charities. This policy explains what personal information we collect through befriendcows.org, why we collect it, who else sees it, and what you can do about it.

Our supporters are mainly in the United States and India, and this policy meets the requirements of both — including India's Digital Personal Data Protection Act, 2023. We have also chosen to extend the protections of the European Union's General Data Protection Regulation to everyone who uses this site, whether or not the law requires it of us.

We have tried to write this in plain language. If anything here is unclear, ask us at info@befriendcows.org and we will explain it.

1. Who we are

The organization responsible for your information — the "data fiduciary" under Indian law, the "business" under US state law, the "data controller" under European law — is:

2. Information we collect

Information you give us

  • When you donate: your name, email address, postal address, donation amount, and the program you chose to support. Card details go directly to our payment processors — we never see or store a full card number.
  • When you subscribe: your email address, and your name if you provide it.
  • When you contact us: whatever you include in your message, including your name and email.
  • When you download a resource or complete an interactive tool: your email address and the answers you give.

Information collected automatically

  • Device and connection data: IP address, browser type, operating system, referring page, and the pages you view.
  • Usage data: which pages you read, how long you stay, and where you click.
  • Session recordings and heatmaps: where you have consented, we record how visitors move through pages — cursor movement, scrolling, clicks, and page transitions. These recordings are configured to suppress the contents of form fields. They are used to find where the site confuses people, not to identify individuals.

Everything in this group beyond what is strictly necessary to run the site is collected only after you consent. See Section 5.

Information from other sources

Our donation platforms pass us the transaction details needed to acknowledge your gift and issue a receipt. If you reach us through a link in an email we sent, our email platform tells us which link you followed.

3. How we use your information

  • To process donations, issue receipts, and meet our record-keeping obligations as a registered charity.
  • To send you the email you asked for — updates, resources, and appeals — and to let you unsubscribe at any time.
  • To answer your questions and provide the resources you request.
  • To understand how the site is used, so we can make it clearer and more useful.
  • To measure whether our advertising reaches people who care about this work.
  • To protect the site against fraud, abuse, and security threats.
  • To comply with the law.

We do not sell your personal information. We do not rent or trade donor lists. We do not use your information to build profiles for anyone other than ourselves, and we never use it for purposes you would not expect from the list above. We do not make automated decisions that produce legal or similarly significant effects about you.

4. Our basis for using it

Most of what we do rests on your consent, which you give freely and can withdraw at any time. The exceptions are narrow and specific. The right-hand column names the formal legal basis for readers who need it.

Where we rely on legitimate interests, we have weighed our interest against your rights and concluded that what we do is what you would reasonably expect and is not intrusive. You can object at any time — see Section 11.

Withdrawing consent is as easy as giving it, and takes effect immediately. Withdrawing does not undo anything lawfully done beforehand — your past donation receipts still exist — but it stops the processing going forward.

5. Cookies and tracking technologies

A cookie is a small file a website stores in your browser. We use them for three things: to make the site and donation checkout work, to understand how the site is used, and to measure our advertising.

Nothing beyond what is strictly necessary runs until you choose. When you first visit, a banner asks you to accept all, reject all, or choose by category. Analytics and marketing technologies stay switched off until you allow them. Rejecting is one click, in the same place, at the same size as accepting.

To change or withdraw your choice at any time, use the Cookie preferences link in the footer of every page. Withdrawing also deletes the analytics and marketing cookies already set in your browser.

  • Analytics — how pages are found, read, and where people get stuck. Includes session recording.
  • Marketing — email platform functionality and advertising conversion measurement.

Our donation platforms may set additional cookies during checkout. Because we use Google Consent Mode, Google's tools receive your consent state and adjust what they collect accordingly — when you have not consented, they collect no identifiers and set no advertising cookies.

6. Who we share information with

We share personal information only with service providers who help us operate, and only as much as each one needs. Each is bound by a written agreement to protect it and to use it only on our instructions.

We may also disclose information if the law requires it, to establish or defend legal claims, or to protect the safety of people or animals. If Befriend Cows ever merges with or transfers its operations to another organization, donor information may transfer as part of that — and we would tell you first.

7. Where your information goes

Befriend Cows is based in the United States, and our service providers are primarily located there. If you are outside the US, your information is transferred to and stored in the United States, which has different data protection laws than your own country.

Where information is transferred out of the European Economic Area, the United Kingdom or Switzerland, we rely on the European Commission's Standard Contractual Clauses — together with the UK International Data Transfer Addendum where relevant — in our agreements with each provider. You can ask us for a copy of those safeguards at info@befriendcows.org.

Our grants to partner sanctuaries in India transfer funds only. We do not share donor or subscriber personal information with our partner organizations. Your name, email address, and giving history stay with us and the service providers listed in Section 6 — they are not passed on to the sanctuaries your gift supports.

8. How long we keep information

  • Donation records: five (5) years, to meet tax, audit, and charity reporting requirements.
  • Email subscribers: until you unsubscribe, plus a short suppression record so we do not email you again by mistake.
  • Enquiries: two years after the conversation ends.
  • Analytics data: up to 14 months in Google Analytics.
  • Session recordings: up to 365 days in Hotjar.
  • Consent records: 180 days in your browser, matching the consent cookie.

When a retention period ends, we delete the information or remove everything that could identify you.

9. Your rights

We offer these rights to everyone who contacts us, wherever you live. We would rather give you control than make you prove which law covers you.

  • Know and access — a summary of what we hold about you, why, and who we have shared it with, plus a copy.
  • Correct and complete — fix anything wrong or out of date.
  • Erase — delete your information, where we have no legal obligation to keep it.
  • Restrict — pause our use of your information while a dispute is sorted out.
  • Port — receive the information you gave us in a structured, machine-readable format, or have us send it to another organization.
  • Object — to any use we base on legitimate interests, and to direct marketing at any time and for any reason.
  • Withdraw consent — at any time, as easily as you gave it.
  • Complain — to us first, and to your regulator if we do not resolve it.

Email info@befriendcows.org to exercise any of these. We respond within 30 days. We will not charge you, and we will not treat you differently for asking.

We may need to verify your identity first — usually by confirming the email address we already hold.

10. If you are in India

India's Digital Personal Data Protection Act, 2023 gives you specific rights as a Data Principal, and places specific duties on us as a Data Fiduciary. In addition to everything in Section 9:

  • Right to nominate. You may nominate another person to exercise your rights on your behalf if you die or become incapable of doing so yourself. Email us to make a nomination.
  • Right to grievance redressal. You can raise a complaint with our Grievance Officer, named in Section 18, and we must respond. You do not have to exhaust any other step first.
  • Right to complain to the Board. If our response does not resolve the matter, you may complain to the Data Protection Board of India.
  • Notice in your language. You may request this notice in English or in any language listed in the Eighth Schedule to the Constitution of India. Email us and we will provide it.

You also have a duty under the Act not to make false or frivolous complaints, and not to impersonate someone else when exercising these rights.

We ask for your consent separately from our terms, in plain language, and itemized by purpose — so that agreeing to one thing does not silently agree to another.

11. If you are in the EU, EEA, UK or Switzerland

Befriend Cows does not have an establishment in Europe and does not direct its fundraising or programs at people there. Even so, we have chosen to apply the standards of the General Data Protection Regulation to everyone who uses this site.

That means every right in Section 9 is available to you in the form GDPR describes it: access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), portability (Art. 20), objection including to direct marketing (Art. 21), and withdrawal of consent (Art. 7(3)). Section 4 sets out the legal basis for each thing we do, and Section 7 describes the safeguards we use when information leaves Europe.

We will respond to any request within one month, and we will tell you if we need longer and why.

If you believe we have handled your information badly, please tell us first at info@befriendcows.org — we would rather fix it. You may also lodge a complaint with the supervisory authority in the country where you live or work.

12. If you are in the United States

Several US states give residents privacy rights. Depending on where you live, these may include the right to know what personal information we collect, to get a copy of it, to correct it, to delete it, to opt out of targeted advertising, and not to be discriminated against for exercising any of them. Everything in Section 9 is available to you regardless of which state you live in.

We do not sell personal information, and we do not share it for cross-context behavioral advertising as those terms are defined under California law.

To opt out of advertising measurement, use the Cookie preferences link in the site footer and switch off the Marketing category. For anything else, email info@befirendcows.org.

An authorized agent may make a request on your behalf with written proof of authorization. If we decline a request, we will explain why, and you may appeal by replying to our response.

13. California Shine the Light

California Civil Code § 1798.83 lets California residents ask once a year for a list of the third parties to whom we disclosed personal information for those third parties' own direct marketing purposes. We do not disclose personal information for that purpose. To confirm this in writing, email info@befriendcows.org.

14. Security

We use HTTPS across the site, keep card data out of our own systems entirely by routing payments through established processors, and limit access to donor information to the people who need it. No system is perfectly secure, and we cannot promise that a determined attacker will never succeed — but if a breach affects your information, we will notify you and the relevant authorities as the law requires, including the Data Protection Board of India and any European supervisory authority where applicable.

15. Children and young people

Our fundraising and our email programs are for adults. We do not knowingly collect personal information from children through this website.

Different countries set the line in different places, and we apply whichever is strictest for the person concerned:

  • India — a child is anyone under 18. We must obtain verifiable consent from a parent or lawful guardian before processing a child's personal information, and we do not track children, monitor their behaviour, or direct advertising at them.
  • Europe — consent for online services requires a parent or guardian below the age set by each country, which is between 13 and 16.
  • United States — we do not knowingly collect personal information from children under 13 without verifiable parental consent.

We publish humane education materials intended for classroom and family use. Those materials are designed so that students can use them without giving us any personal information. Where a teacher or school takes part in one of our programs, we work with the adult educator, and any information about students stays with the school unless a parent or guardian has given us verifiable consent directly.

If you believe a child has given us personal information, email info@befriendcows.org and we will delete it.

16. Global Privacy Control

Browsers vary in how they signal tracking preferences, and there is still no single standard for Do Not Track. Where your browser or an extension sends a Global Privacy Control signal, we treat it as an opt-out of targeted advertising. You can always set your preferences directly through the Cookie preferences link in the footer.

17. Changes to this policy

We update this policy when our practices change — when we add a new tool, for instance, or change how something works. The effective date at the top tells you when the current version took effect. If a change materially affects how we use your information, we will make it obvious, not bury it.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

Sensitive Information. We do not process sensitive information.

Payment Data. We may collect data necessary to process your payment if you choose to make purchases, such as your payment instrument number, and the security code associated with your payment instrument. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information such as your Internet Protocol (IP) address and/or browser and device characteristics is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLS, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings). 
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

Google API

Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails at any time. For more information, see "WHAT ARE YOUR PRIVACY RIGHTS?" below. 
  • To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more. 
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest, such as to prevent harm.

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (ie, legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent 
  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to 
    Send users information about special offers and discounts on our products and services 
    Develop and display personalized and relevant advertising content for our users 
  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, exercise or defend our legal rights, or disclose your information as evidence in litigation in which we are involved. 
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (ie., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way 
  • For investigations and fraud detection and prevention 
  • For business transactions provided certain conditions are met 
  • If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim. 
  • For identifying injured, ill, or deceased persons and communicating with next of kin 
  • If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse 
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province 
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records 
  • If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced 
  • If the collection is solely for journalistic, artistic, or literary purposes 
  • If the information is publicly available and is specified by the regulations

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. 
  • When we use Google Maps Platform APIs. We may share your information with certain Google Maps Platform APis (e.g., Google Maps API, Places API). Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS is accurate to about 20 meters, while Wi-Fi and cell towers help improve accuracy when GPS signals are weak, like indoors. This data helps Google Maps provide directions, but it is not always perfectly precise. We obtain and store on your device ("cache") your location for three (3) months. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.

To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?"

Google Analytics

We may share your information with Google Analytics to track and analyze the use of the Services. The Google Analytics Advertising Features that we may use include: Remarketing with Google Analytics and Google Analytics Demographics and Interests Reporting. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout. You can opt out of Google Analytics Advertising Features through Ads Settings and Ad Settings for mobile apps. 6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. You will then be removed from the marketing lists. 10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
